Introduction

On 1 July 2009, six Joint Regional Planning Panels (JRPP’s) commenced operation across New South Wales, with the responsibility of determining ‘regionally significant’ development applications.  Regional development is development which is notified and assessed by a local Council and then determined by the relevant JRPP.  Each JRPP consists of three experts appointed by the Minister, and two local government representatives appointed by the relevant local Council.

Cessnock Local Government Area is located within the Hunter and Central Coast Region.  The JRPP makes decisions on the following categories of development (details of projects that are determined by JRPP’s are set out in Schedule 4A of the Environmental Planning and Assessment Act 1979). 

  • development with a Capital Investment Value (CIV) over $20 million
  • development with a CIV over $5 million which is:
    • council related
    • lodged by or on behalf of the Crown (State of NSW)
    • private infrastructure and community facilities or
    • eco-tourist facilities
  • extractive industries, waste facilities and marinas that are designated development
  • certain coastal subdivisions
  • development with a CIV between $10 million and $20 million which are referred to the regional panel by the applicant after 120 days
  • crown development applications (with a CIV under $5 million) referred to the regional panel by the applicant or local council after 70 days from lodgement as undetermined, including where recommended conditions are in dispute.

How Do Regional Panels Operate?

State Environmental Planning Policy (State and Regional Development) 2011 sets out the functions of regional panels in determining applications for regional development.

In the event a development application is classified as ‘regionally significant’, the proponent will submit the application to Council for assessment.  Council will assess the application, and if required, carry out referrals to external authorities and advertise the development application.  Council will then finalise the assessment of the development application and forward the council officer’s assessment report and recommendation/s to the Hunter and Central Coast Regional Planning Panel for determination.  This process is shown below:
