Disclosure of Political Donations and Gifts

Making a planning or development application

Under Section 10.4 of the Environmental Planning and Assessment Act 1979 (NSW) (Act), if you submit a planning application to us you are required to disclose information about political donations and gifts made by any person with a financial interest in the application.

This includes information about:

  • All reportable political donations made to any of our Councillors; and
  • All gifts given to any of our Councillors or staff.

This information needs to cover the period commencing two years before the application is made and ending when the application is determined.

This law is designed to improved the transparency of the planning system and minimise any perception of undue influence by:

  • Requiring public disclosure of the political donations or gifts at the time planning development applications (or public submissions relating to them) are made;
  • Providing the opportunity for appropriate decisions to be made about the persons who will determine or advise on the determinations of the development or planning applications.

Political donations or gifts are not relevant to the determination of any development application or planning matters. The making of political donations or gifts does not provide grounds for challenging the determination of a development application or planning decision.

You must complete the political disclosure form if you have made any reportable political donations.

Disclosures made available to the public

Disclosures of reportable political donations and gifts are to be made available to the public within 14 days by the disclosure being place on a website maintained by Council.

Making a public submission

If you are lodging a submission to us on a development application or a planning matter you are required to disclose information about political donations and gifts (if any) made by any person with a financial interest in the application.

This includes information about:

  • All reportable political donations made to any of our Councillors;
  • All gifts given to any of our Councillors or staff.

This information needs to cover the period commencing two years before the application is made and ending when the application is determined.

Under the Act, it is an offence not to provide a disclosure of political donations or gifts.

Public information

We are required to retain the political donations and gifts forms made by applications and those lodging public submissions about development applications.

Clause 1(3)(e) of the Government Information (Public Access Regulation 2018 (NSW) requires us to make the disclosures available to the public.
