The Application may be inspected at Council’s Customer Services Counter, 62-78 Vincent St, Cessnock during ordinary office hours between 15 February 2017 to 17 March 2017 (inclusive).
The application was originally notified from 11 January to 10 February 2017 (inclusive). Please be advised that the plan of subdivision and staging plan (prepared by HDB Planning Design & Development titled ‘Masterplan’ and
‘Staging Plan’ dated October 2016) exhibited during this period were incorrect given the proposal only involves residential subdivision in six (6) stages. As such, the tourism component of the application has been removed and the associated parcel known as ‘Stage 7’ will remain a residual rural lot created under Stage 6 of the development.
The proposal is also “Nominated Integrated Development”. This means that additional approvals under other legislation are required. The other approvals are as follows:

Any person may, during the exhibition period, make a submission in writing to the Council in relation to the application. Submissions are NOT kept confidential. Council releases submissions when a request is made in accordance with privacy laws and the relevant provisions under the Government Information (Public Access) Act 2009. When a submission is released by law, Council routinely withholds contact numbers, email addresses and signatures. Should you wish for all personal details or any information that may identify you to be withheld from the public, please advise Council of this in your submission.
Where a submission is made by way of an objection, the grounds for objection must be clearly specified. Council will consider all submissions before a decision on the matter is made. An acknowledgement of your submission will be made no earlier than one (1) week after the exhibition closing date.
Should you intend to make a submission to Council on any planning related matter, your attention is drawn to your statutory obligations under the Environmental Planning and Assessment Act 1979 regarding disclosure of political donations and gifts.

If the application is approved, a person who makes a submission by way of objection does not have a right of appeal to the Land and Environment Court unless a matter of law arises.
