The provisions within Section 94 (S94) of the Environmental Planning & Assessment Act 1979, as amended, enable Councils to obtain development contributions as a means of funding local infrastructure & services that are required as a result of new development.
Councils must adopt Contributions Plans before contributions can be levied. A contributions plan identifies the public infrastructure, services & amenities required to meet the demand of development. Examples include open space, recreation facilities, road construction, car parking and community facilities.
Cessnock City Council has prepared the following Section 94 Contributions Plans which levy contributions on development generally:
Contributions payable under the plans are regularly indexed (reviewed) accordingly to provisions within the respective plans and the revised rates are included within the plans available on this web-site.

Kitchener (Amendment No. 124) Note: The Land has been zoned No 2(c) (Residential (Development Control Area) Zone) in the written instrument of Amendment No. 124 to the Cessnock Local Environmental Plan 1989 gazetted 28 May 2010. The supporting map to Amendment No. 124 to the Cessnock Local Environmental Plan 1989 has the land zoned as No 1(a) (Rural "A" Zone). A copy of Amendment No. 124 to the Cessnock Local Environmental Plan is attached. This issue is before the Department of Planning for remedying as to the correct zoning of the land.
